2.1 Solv attaches great importance to your privacy and data protection and therefore takes all appropriate measures to protect your personal data processed by or through Solv as well as to be compliant with Belgian and European data protection laws, including the EU General Data Protection Regulation 2016/679 (“GDPR”) and any applicable national implementing and supplementing laws.

2.2 In this Privacy Policy Solv explains to you what personal data it processes about you, how it does so, why and on what basis Solv does this, what rights you have and with whom Solv may share your personal data. Solv tries to inform you as transparently as possible.

2.3 Solv recommends that you read this Privacy Policy carefully. You can access this Privacy Policy at any time under the “Privacy Policy” section on the Website.

2.4 This Privacy Policy does not cover the privacy policies, statements or terms of any third party nor of websites or applications referred by hyperlinks on the Website.

2.5 Solv may modify this Privacy Policy at any given time. It is therefore important that you consult it regularly. You will always find the most up-to-date version on the Website. The date of the last amended version is listed at the bottom of this Privacy Policy. Any changes will be communicated via the Website, by e-mail or through other electronical channels.

2.6 This Privacy Policy is subject to Belgian law. Only the courts of Antwerp (Antwerp division(s))) are exclusively competent to decide on any dispute that may arise from the interpretation or implementation of this Privacy Policy, without prejudice to your right to present a dispute before a competent court on the basis of a mandatory statutory provision.

If you do not provide us with certain information or personal data, such as your identification data, Solv will not be able to contact you, provide you with a quote or provide any services to you whatsoever.

Solv may process your personal data to ensure the optimal functioning of and to optimize and support its Website. When you use the Website, Solv may process certain electronic data in this regard, such as cookies for mobile devices or similar technologies that are used to collect data. They can facilitate the interaction between you as a user/visitor and the Website and are used in order to improve your user experience and for the collection of statistics among the users/visitors. Solv can use your personal data for commercial and advertising communication purposes (referred to as direct marketing). Strictly personal communication, greetings and surveys do not constitute direct marketing. Solv can send you commercial and advertising messages about the services it provides or other information that could be interesting of useful to you, by e-mail, newsletter on certain social networks or other means. 

If you are an existing customer of Solv, Solv relies on its legitimate (commercial) interests to process your personal data for direct marketing purposes, which outweigh your (privacy) rights or interests.

However, if you are not an existing customer of Solv, your prior consent (e.g. via subscription on the Website) is required for unsolicited commercial and advertising messages and/or processing of your personal data for direct marketing purposes. Your consent can be withdrawn at any time.

If you wish that your personal data is no longer processed for such commercial and/or advertising purposes, you have the right to object at any time (unsubscribe or oppose to such processing), free of charge and without assigning any reason (see section 10.3 below). Solv may process your personal data to block or deny access to the Website to you or other users who violate any agreement(s) with Solv, its policies, statements or applicable law and to take action against you or other users.

Solv may process your personal data for other legitimate (commercial) purposes to the extent permitted by applicable law, such as to facilitate its operations and services, generate aggregated statistics, perform market analyses, apply its policies, statements and procedures, defend itself against claims or demands, protect its users and/or customers and their rights, and protect the rights of third parties, if any.

Solv may process your personal data for transmission to third parties such as partners, service providers, suppliers, authorities and/or other contracting parties of Solv (see section 7 below) for the implementation of the previous provisions.

6.5 Compliance with applicable laws

Finally, Solv may process your personal data to comply with applicable laws or lawful requests or orders by supervisory authorities, courts or government agencies.

7. With whom will your personal data be shared? 

7.1 Your personal data shall also be processed by the partners of Solv, service providers and/or suppliers in connection with making the Website available to you and implementing and supporting the services Solv provides through the Website. This includes hosting providers, IT-partners, web administrators and/or other partners or service provides of Solv related to the Website.

7.2 Solv verifies with its partners, service providers and/or (sub)processor(s) that they take the necessary and appropriate (security) measures in accordance with the GDPR or other applicable data protection legislation to protect your personal data and concludes the necessary data protection agreements with its (sub)processor(s).

7.3 Solv will not disclose your personal data to third parties, except in case of the disclosure of information permitted by applicable law or referred to in this section 7 or elsewhere in this Privacy Policy. Solv is not responsible for the processing of your personal data by third parties who do not do so on behalf of Solv but are (completely) responsible for it themselves.

7.4 Finally, Solv may be required, by law or in response to a request by supervisory authorities, courts or government agencies, to disclose your personal data to them or to a third party. 

7.5 Your personal data will not be transferred outside the European Economic Area (“EEA”). If your personal data would be transferred to countries outside the EEA in respect of which the European Commission has not determined that such countries provide an adequate level of protection for personal data, Solv will ensure that (additional) measures are taken in accordance with the applicable data protection legislation (e.g. the implementation of standard contractual clauses made available by the European Commission and/or any other addition measures).

8. How long does Solv keep your personal data? 

8.1 Solv will not keep, collect, handle or process your personal data longer than necessary for the purposes as described above in section 6. Solv endeavours to use the minimum data that is required for the purposes and/or by law. Without prejudice to the generality of the foregoing, your identification and electronic data (see section 5 above) will be kept by Solv for as long as you use the Website in connection with which such personal data is processed, unless special legal provisions apply to the storage or processing thereof or longer storage or processing is required to defend Solv’s interests in legal proceedings or unless there is any other specific legitimate interest of Solv in this regard for longer storage or processing.

8.2 The retention period for your personal data may vary depending on the purposes of the processing and Solv’s legal obligations. In any case, the general principle always applies that Solv does not keep your personal data longer than necessary. If your personal data are no longer required for the purposes intended, Solv will, if necessary, delete or otherwise anonymise your personal data.

9. What are your rights and how can you exercise them? 

9.1 You have the right to receive information about the processing of your personal data via the Website. All necessary information is communicated to you via this Privacy Policy. You can also request additional information from Solv at any time. 

9.2 You have the right to request Solv to: 

9.3 You have the right to object the processing of your personal data. You can also object to the processing of your personal data for direct marketing at any time and free of charge (see section 6.3 above). This can be simply done by sending Solv an e-mail at privacy@solv.world.

9.4 You have the right to transfer your personal data or have your personal data transferred directly (to another “data controller”) (“portability”). However, this is only possible if the processing by Solv is based on your consent or if the processing by Solv is performed via automated processes and then only on the condition the personal data you have provided to Solv is in a structured, commonly used and machine-readable form.

9.5 If the processing of your personal data is based on your consent, you have the right to withdraw your consent at any given time.

This will not affect the lawfulness of the processing of personal data on the basis of your consent that was granted prior to your withdrawal.

9.6 If you believe that the processing of your personal data by Solv violates the applicable regulations, you have the right to lodge a complaint with the Data Protection Authority (“Gegevensbeschermingsautoriteit”) located at 1000 Brussels, Drukpersstraat 35, Belgium, with phone number +32 (0)2 274 48 00 and e-mail address contact@apd-gba.be. In the event of such a complaint, you can also contact Solv itself at any given time through privacy@solv.world

If you indeed are under the impression Solv has violated the applicable regulations, Solv would like to have the opportunity to deal with any issues. Therefore Solv kindly asks you to reach out to her first before contacting the Data Protection Authority (“Gegevensbeschermingsautoriteit”).

9.7 The exercise of your rights, as set forth above, is always subject to the requirements and conditions stipulated in applicable legislation (such as but not limited to the GDPR).

9.8 Solv always tries to answer your questions and/or requests as quickly as possible. 

9.9 To exercise your rights, you can simply send a request to Solv via privacy@solv.world. In doing so, you must adequately identify yourself. If Solv has reasons to doubt your identity, it may ask you for additional information necessary to verify and confirm your identity.
